1. Introduction
These Terms and Conditions ("Terms") apply to all services provided by FJ Electrical ("we", "us", "our"), a sole trader electrician business based in New Zealand. By engaging our services, you ("the customer", "you") agree to these Terms.
2. Scope of Services
We provide a range of electrical services, including but not limited to installations, repairs, maintenance, and inspections. The specific services to be provided will be outlined in our quotation or agreed upon in writing before the commencement of work.
3. Quotations and Estimates
- All quotations provided are valid for 30 days from the date of issue unless otherwise stated.
- A fee will be charged for providing quotations or estimates. This fee will be communicated to you prior to the preparation of the quotation or estimate and must be paid in advance.
- The fee for the quotation or estimate is non-refundable and will be charged regardless of whether the quotation or estimate is accepted or the work proceeds.
- If the quotation or estimate is accepted and the work proceeds, the fee may be deducted from the final invoice at our discretion.
- Detailed breakdowns of the estimate will be provided at our discretion and only if the customer proceeds with the work. We reserve the right not to provide further details of the estimate if it is not accepted.
- Any variations or additional work outside the scope of the initial quotation will be charged accordingly and must be agreed upon by both parties before proceeding.
4. Invoicing and Payment
- Charges will be based on our quotation, invoice, or the rates applicable at the time of service. Travel costs may be charged separately.
- We reserve the right to adjust prices if there are changes to the materials, scope of work, or unforeseen difficulties.
- Payment is due as specified on the invoice, which may include progress payments. Payment methods include electronic/online banking or as otherwise agreed.
- A deposit may be required at our discretion. All prices are inclusive of GST unless otherwise stated.
5. Cancellation and Rescheduling
If you need to cancel or reschedule a booked service, please provide at least 2 hours notice.
6. Liability
- We will perform all work with reasonable skill and care. However, we are not liable for any loss, damage, or injury arising directly or indirectly from our services unless caused by our negligence.
- Our liability for any claim related to our services is limited to the value of the service provided.
7. Warranties and Guarantees
- We offer a 1-year warranty on workmanship from the date of completion of the service. Please note that any materials or items provided by third parties, such as electrical components or fixtures, may have their own manufacturer warranties, which can differ in duration. The specific warranty periods for these items will be provided to you at the time of installation.
- This warranty does not cover defects or issues arising from misuse, unauthorized repairs, or modifications by the customer or a third party.
8. Health and Safety
We adhere to all relevant New Zealand health and safety regulations while performing our services. Customers must ensure that the worksite is safe and accessible for us to carry out the required services.
9. Consumer Guarantees Act
Nothing in these Terms affects your rights under the New Zealand Consumer Guarantees Act 1993. If you are a consumer under this Act, you have certain rights regarding the quality and delivery of our services.
10. Confidentiality and Privacy
- We respect your privacy and will only collect, use, and store your personal information in accordance with the New Zealand Privacy Act 2020.
- We will not disclose your personal information to third parties without your consent unless required by law.
11. Force Majeure
We are not liable for any failure to perform our obligations under these Terms due to circumstances beyond our control, including but not limited to natural disasters, acts of war, or government restrictions.
12. Governing Law
These Terms are governed by the laws of New Zealand. Any disputes arising from these Terms or our services shall be subject to the jurisdiction of the courts of New Zealand.
13. Changes to Terms
We reserve the right to update or modify these Terms at any time. Any changes will be posted on our website, and it is your responsibility to review the Terms regularly. Continued use of our services after any changes indicates your acceptance of the new Terms.
